Seven Certified Class Action Trials. Scores of Happy Clients. Wheeler Trigg O'Donnell's 35-lawyer class action defense group has handled hundreds of class actions in state and federal courts across the United States. WTO lawyers have won motions to dismiss and defeated certification in dozens of cases and, after being brought in to redirect cases gone astray, have successfully decertified classes on multiple occasions.
Representative class action clients include Allstate, AT&T, BP, Electrolux, Farmers, Ford, Michelin, Toyota, and Whirlpool. As the diversity of our clients suggests, we have extensive experience handling complex class actions involving a wide variety of substantive areas of law, including healthcare, consumer fraud, insurance, product liability, traumatic brain injury, employment, energy and natural resources, securities, antitrust, and telecommunications.
Established Depth of Experience
Six WTO partners have tried seven certified class action jury trials and obtained defense verdicts and favorable mid-trial settlements for clients such as BP, Ford, and Whirlpool. We are not aware of any defense firm in the country that has more experience trying certified class actions.
That depth of experience informs our approach to defending every case we handle. Although it is extremely rare for any certified class action to be tried to verdict, our experience taking certified class actions to trial and winning helps our clients achieve better results and more favorable settlements when they elect to resolve class actions for any reason.
As an example of the exceptional value we deliver to clients, WTO serves as national class action counsel to Whirlpool and has handled over 50 class actions for that company alone. Our relationship has been so effective that Whirlpool and WTO were recognized with the Association of Corporate Counsel Value Champions Award in 2012 for collaboration resulting in real innovation, increased value, and improved outcomes for both our client and the firm. Since then, BTI Consulting has named two members of the class actions team Client Service All-Stars. According to BTI, “the only way to become a BTI Client Service All-Star is for corporate counsel to single out an attorney for client service exceeding all others.”
