Kimberly Berve represents clients at the trial and appellate level in state and federal court in various areas of civil litigation, such as energy, insurance, and franchise law.  Kim's recent work has included the following matters:

  • With WTO partner Craig May, obtaining an order from the Colorado Court of Appeals affirming the dismissal of a suit against WTO’s client that challenged the validity of a Colorado oil and gas lease. 
  • On appeal to the Colorado Court of Appeals, helping to vacate an order of contempt awarding $10,000 per day in sanctions against WTO’s client for allegedly failing to adhere to a settlement agreement.
  • Assisting in a Tenth Circuit appellate victory, in which WTO successfully obtained a complete reversal, remand, and entry of judgment in favor of our client, which was at the time a natural gas drilling company.
  • Assisting WTO partners Hugh Gottschalk and Matthew Johnson in representing an independent oil and gas exploration company based in The Woodlands, Texas in a multi-million dollar overriding royalty interest arbitration against a publicly traded company that operates wells on the lands in question in the Uintah Basin, Utah.
  • With WTO partner Jessica Scott, successfully defending a judgment on the pleadings in favor of WTO's insurance company client in the Colorado Court of Appeals.

Prior to joining WTO in 2012, Kim served as a law clerk to The Honorable John Daniel Dailey of the Colorado Court of Appeals.  She earned her law degree with honors from the University of Denver Sturm College of Law, where she served as a student attorney in the Civil Rights Clinic.
