Recent decisions in insurance cases have broadened the scenarios where the attorney-client privilege is being pierced. Whether it is based on the common-law crime/fraud exception to the privilege or more exotic arguments, more and more often the sacred privilege between an attorney and a client in the insurance arena is under attack.
