Shawn Neal
 

Shawn Neal represents clients in complex commercial disputes at the trial and appellate levels. She has trial experience in an oil and gas case and a significant franchise dispute.

Within her first year of practice, Shawn appeared in a seven-day jury trial in federal court. In addition to arguing numerous pre-trial motions, she prepared, examined, and cross-examined multiple witnesses during trial. Shawn has also prepared and defended expert witnesses in depositions, argued discovery motions in court, and drafted summary judgment motions, Daubert motions, and motions to dismiss.

Prior to joining WTO, Shawn worked as a law clerk to The Honorable John R. Webb on the Colorado Court of Appeals. While in law school, Shawn also worked as a summer associate for a Denver litigation firm, where she assisted with a trial in federal court involving a natural gas dispute. Shawn helped with pre-trial matters and sat at counsel table, assisting throughout trial with witness and exhibit preparation.

Shawn attended law school on a full-tuition scholarship and received the Sturm College of Law Outstanding Student Leader Award for her innovative work as Senior Articles Editor for the Denver University Law Review. Before law school, Shawn dedicated eight years to a career in education and youth development, including teaching first grade.

Shawn Neal represents clients in complex commercial disputes at the trial and appellate levels. She has served on two trial teams and has examined witnesses during trial. Shawn has also handled depositions and drafted summary judgment motions, Daubert motions, and motions to dismiss.

Representative Cases
  • Won an arbitration award for a lawyer and law firm against malpractice claims related to a 2014 real estate deal. Claimants asserted damages of $3 million plus interest. The arbiter ruled for WTO's client and found that no malpractice occurred.
  • Hooman v. FCA US LLC (2016) - Successfully represented FCA in a one-week trial in California involving a dealer's claim regarding an allegedly improper sales incentive audit. WTO achieved a successful proposed decision at the trial level, which it successfully defended before the Board, receiving complete affirmation of the proposed order. WTO later successfully defended the Board's adoption of the proposed order in a subsequent writ filed by the dealer.
  • SFK v. Isuzu (2016) - Represented Isuzu in a seven-day jury trial in federal court involving a dealer's claim for wrongful termination, declaratory judgment, breach of contract and claims of violations under South Dakota statute regarding warranty reimbursement and parts mark-up rates.
  • Defended a natural gas gathering company in a five-day bench trial in federal court involving a breach of contract dispute against a natural gas production company.
  • Defended a large utility company in a wrongful death suit in which the plaintiffs alleged almost $3.5 million in damages. Minutes before the summary judgment hearing, and less than two weeks before trial, the plaintiffs voluntarily dismissed WTO's client from the lawsuit.
