WTO obtains complete defense verdict for Ford in breach of warranty trial

On October 17, 2012, the Jefferson County, Colorado District Court returned a complete defense verdict on behalf of Ford Motor Company in a breach-of-warranty trial.  The plaintiff in the case filed suit for breach of implied warranty and breach of written warranty under the Magnuson-Moss Warranty Act claiming that his platinum-edition truck, manufactured and warranted by Ford, had a defective transmission that Ford's dealerships failed to repair while it was under warranty. 

The plaintiff and his expert testified to the alleged continuing defect and the diminution in value that it caused and sought damages, attorney fees, and costs under the Magnuson-Moss Warranty Act.  Ford maintained that the plaintiff's truck contained no defect.

After a two-day trial, the jury returned a complete defense verdict in Ford's favor.
