Won affirmation before the Colorado Court of Appeals of a defense verdict for a labor and delivery nurse.

Warden v. Exempla (Colo. App. 2014)

WTO partner Kevin Kuhn, with counsel for two co-defendants in the case, won affirmation of a complete defense verdict WTO obtained in 2013 for a labor and delivery nurse in Boulder District Court. The three-and-a-half-week trial involved a baby born with cerebral palsy, allegedly as a result of the nurse's misinterpretation of fetal monitor readings during labor. WTO lawyers demonstrated instead that the brain injury was a tragic and unpreventable complication resulting from meconium aspiration syndrome.

The Colorado Court of Appeals upheld the trial court's complete jury defense verdict for our client and the other two defendant healthcare providers.
