Obtained summary judgment in Denver District Court in a professional negligence claim against WTO's client, a construction consultant, in a matter related to criminal charges brought against the consultant's client, Xcel Energy.
On June 1, 2011, Denver District Court granted summary judgment in a civil litigation matter on behalf of WTO's client, a construction consultant to Colorado's Xcel Energy. WTO defended the consultant in a professional negligence lawsuit related to a nationally publicized federal criminal trial in which Xcel was charged with willfully violating OSHA safety regulations. In 2007, five workers died in a fire at a Colorado hydro-electric plant operated by Xcel. In late June, 2011, a jury acquitted Xcel on all counts.
