Biography

Lyndsey Cain represents clients in complex product liability, professional liability, and commercial disputes nationwide. As a Fellow in the Maryland Public Defender’s Office, Lyndsey served as lead or co-lead counsel in 10 trials. She has delivered 15 opening and closing arguments and conducted more than 30 direct and cross-examinations of witnesses.

Lyndsey is committed to zealous advocacy at every stage of litigation and has experience arguing discovery and dispositive motions in state and federal courts, handling expert witness preparation, and managing all aspects of discovery—including in multidistrict litigation and other complex coordinated litigation. A committed client advocate, Lyndsey directly addresses every question of law and strategy with an eye toward trial.

Prior to joining WTO, Lyndsey served as an associate at a leading D.C. litigation firm, a federal judicial clerk in the Eastern District of North Carolina, and a litigation intern for two Fortune Global 500 corporations. 
 

Cases

  • Won voluntary dismissal in federal court in Colorado for a major gas station company facing federal and state toxic tort claims brought by a real estate developer. The plaintiffs voluntarily dismissed their claims after WTO demonstrated that the gas station's underground gas tanks did not contaminate the plaintiffs' adjacent land and water.
  • Argued and won a preliminary injunction motion in federal court seeking to restrain the client's former employee from dissipating embezzled funds.
  • Won acquittal on all felony counts in a jury trial as the sole defense attorney for a client accused of felony possession with intent to distribute illegal drugs. Cross-examined all trial witnesses including two expert witnesses and delivered opening and closing statements. This representation occurred before Ms. Cain joined WTO.
  • Won acquittal on all felony counts as first chair in jury trial for a client accused of felony assault of a rideshare driver. Cross-examined multiple witnesses and delivered closing statement. This representation occurred before Ms. Cain joined WTO.
  • Won a jury trial as first chair for a client accused of felony possession with intent to distribute illegal drugs. Cross-examined several witnesses and delivered closing statement. This representation occurred before Ms. Cain joined WTO.
  • Won motion for judgment of acquittal as first chair in a jury trial for a client accused of felony fraud. Cross-examined witnesses and argued the winning mid-trial motion. This representation occurred before Ms. Cain joined WTO.
  • Won a jury trial as second chair for a client accused of felony possession of a firearm. Delivered opening statement and cross-examined the only trial witness. This representation occurred before Ms. Cain joined WTO.
  • Won a bench trial as the sole defense counsel in Maryland District Court for a client accused of misdemeanor harassment. This representation occurred before Ms. Cain joined WTO.
  • Represented a client accused of felony possession of a firearm as second chair in a jury trial. Obtained favorable sentencing result. This representation occurred before Ms. Cain joined WTO.
  • Successfully represented a pharmaceutical company as national counsel in a four-year, federal product liability MDL. Managed several aspects of the litigation including a multimillion-page document review, depositions, and witness prep. Ultimately, all of the claims were either dismissed or favorably resolved. This representation occurred before Ms. Cain joined WTO.
  • Won summary judgment and dismissal of all claims for a healthcare insurer in a case brought by a medical association. Took multiple depositions and helped brief summary judgment and motions in limine. The seven-year-old case was inherited from another firm less than five months before the originally-scheduled trial. This representation occurred before Ms. Cain joined WTO.
  • Represented several hundred clients accused of misdemeanors as sole defense counsel in Maryland District Court. Obtained dismissal and favorable resolutions for dozens of clients, including in four bench trials. These representations occurred before Ms. Cain joined WTO.
  • Argued more than ten contested motions to suppress evidence in felony cases in Maryland Circuit Court. These representations occurred before Ms. Cain joined WTO.
  • Argued cross-motions for summary judgment in a product liability matter in Wisconsin state court. Although all parties' cross-motions were denied, the judge agreed with Ms. Cain's argument on several key issues, which facilitated a favorable settlement for her client. This representation occurred before Ms. Cain joined WTO.
  • Negotiated a favorable resolution in a products liability matter in North Carolina state court.
  • Represented a medical diagnostics manufacturer in a trade secrets action against a former executive. This representation occurred before Ms. Cain joined WTO.
  • Represented individual clients in multiple federal Foreign Corrupt Practices Act investigations. These representations occurred before Ms. Cain joined WTO.
  • Represented a diplomat accused of sexual harassment in an internal investigation. Helped negotiate an outcome that resulted in no action against the client. This representation occurred before Ms. Cain joined WTO.
