Defeated plaintiffs' attempts to centralize nationwide COVID-19 insurance litigation.
WTO lawyers helped win a major ruling for an insurance company from the U.S. Judicial Panel on Multidistrict Litigation. The Panel made national legal news when it rejected attempts by various plaintiffs’ lawyers to create “the largest litigation in U.S. history” by centralizing all federal COVID-19 business-interruption insurance cases. If successful, the plaintiffs’ push to create a single MDL forum would have created thousands of additional cases.
Thanks to efforts by WTO and other firms, the Panel ruled against centralization on the basis that the cases lacked commonality. The Panel’s decision is a terrific victory for the insurance industry and the rule of law.
