Won summary judgment in a first impression case under the Wyoming Hospital Records and Information Act.

In a case of first impression under the Wyoming Hospital Records and Information Act, WTO attorneys won summary judgment to defeat a broad overreach by plaintiffs’ attorneys to obtain wide ranging discovery. The plaintiffs’ attorneys, attempting to set up a spoliation claim in a concurrent medical malpractice action, asserted that the Act permitted unlimited electronic discovery related to a hospital's electronic medical record system. Throughout extensive motion practice and over three years of contentious litigation, the court held in WTO's favor at every turn, ruling the discovery was impermissible and that WTO's client had fully complied with the Act.
