Biography

Carolyn Welter represents clients in complex commercial litigation and legal professional liability matters. She represents law firms and businesses in a wide range of disputes and industries, including franchise, real estate, and consumer products and services. She has diverse experience in the courts, state government, and the private and nonprofit sectors. Prior to joining WTO, Carolyn served as a law clerk to Chief Justice Brian D. Boatright of the Colorado Supreme Court. She also served legal internships with the Hon. N. Reid Neureiter and Colorado Governor Jared Polis.

Cases

  • Following a multiday evidentiary hearing, secured injunctive relief for a franchisor against businesses that were unlawfully competing against it using franchisor's trade secrets, including client information, and infringing on franchisor's trademarks.
  • Argued before the Tenth Circuit for an individual seeking withholding of removal under the Convention Against Torture.
  • Serving as national counsel for a major international company in commercial litigation involving over 180 cases of alleged PCB exposure.
  • Defending national law firms against high-stakes claims of legal malpractice and breach of fiduciary duty.
  • Won a complete motion to dismiss for a national real estate franchisor in a case brought by a franchisee alleging tortious interference and express and implied breaches of the franchise agreement.
  • Won summary judgment on all challenged claims brought against the nation's leading beauty and wellness franchisor, resulting in a favorable settlement to resolve the remaining claims.
  • Vacated a default judgment entered against a construction company in a lawsuit brought by a former investor.
  • Drafted a successful amicus brief to the Colorado Supreme Court addressing Colorado's equal protection guarantee and the rights afforded to criminal defendants.
