Biography

Michael Baker represents clients in antitrust disputes and commercial litigation. He spent a combined five years as an attorney with the Federal Trade Commission in its Anticompetitive Practices Divisions, and he began his career with an Am Law 50 firm in Washington, D.C., focusing on antitrust. Mike’s breadth of antitrust experience gives him a 360-degree viewpoint on the business, legal, and regulatory considerations involved in these complex matters. 

Mike has significant experience—both as a government enforcer and in private practice—in government investigations and litigation regarding various antitrust claims, including exclusive dealing, price fixing, monopolization, attempted monopolization, tying, refusals to deal, information exchanges, and non-compete agreements. He has also represented clients before the FTC and the Department of Justice in all phases of merger review. 

In addition to his stints in private practice and with the FTC, he served as corporate counsel for competition and litigation at an enterprise software solutions company, where he supervised copyright and unfair competition litigation against a major technology company. This experience has provided Mike with a unique perspective regarding the needs of clients engaged in complex litigation.

Matters Prior to WTO

  • Chief of Staff of FTC antitrust case against major consumer website.
  • Conducted FTC investigation and filed first Robinson-Patman Act litigation by the government in more than 20 years against a premier beverage distributor.
  • Led FTC Durbin Amendment investigation into major debit card network.
  • Represented data analytics and consulting company in antitrust litigation in the poultry sector.
  • Represented local television stations in Department of Justice investigation and litigation regarding information exchanges.
