Won a defense jury verdict for a Montana hospital in a birth case.
WTO won a defense verdict for a hospital after an eight-day jury trial in Montana’s Missoula County District Court. The plaintiffs sued the hospital after a baby died during childbirth, claiming $3.1 to $4.65 million in economic damages.
The mother’s uterus tragically ruptured during a VBAC delivery. The plaintiffs argued that our client’s medical team should have made different decisions during labor. WTO lawyers successfully demonstrated that the mother’s medical history presented inherent risks and that the medical team saved the mother’s life.
Numerous Montana lawyers closely watched the trial by Zoom. The hospital employed the doctor and nurses, and the emotionally charged trial concluded with nearly the entire labor and delivery staff in the courtroom for WTO Partner Kevin Kuhn’s closing arguments.
