Biography

Ann Lebeck has significant experience in commercial litigation that includes representing both plaintiffs and defendants. She has focused on representing energy companies and public companies in high-stakes, complex disputes. Her nearly 20-year career in law prior to joining WTO spanned working at boutique and mid-sized firms as well as running her own solo practice. This broad experience has given her a practical, solutions-based approach to client matters. Ann’s leadership in the legal industry includes chairing the State Bar of Texas’s Women in the Profession Committee and previously serving on the Colorado Women’s Bar Association’s Board of Directors.

Before attending law school, Ann lived in Osaka City and Tokyo, Japan, before moving to New York City, where she worked for a leading Japanese design-build firm. 

Cases

Matters Prior to WTO

  • Represented public company's subsidiary against over 100 parties, in federal court actions for cost recovery and contribution under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), in relation to Superfund National Priorities List (NPL) site subject to EPA-estimated clean-up costs of over $1 billion.
  • Represented public-company defendant in lawsuit brought by over a dozen parties alleging violations of antitrust laws and deceptive trade practices statutes and seeking over $1 billion.
  • Represented public company's subsidiary in federal court litigation brought by the United States Environmental Protection Agency (EPA) in CERCLA action involving proposed consent decree, over 80 defendants, and more than $1 billion in potential liability.
  • Successfully opposed petition for certiorari in the Supreme Court of New Jersey to defend appellate court's reversal of $65 million judgment.
  • Successfully represented wholesale fuel provider in arbitration involving distributor's failure to purchase minimum required volume of petroleum product under parties' agreement.
  • Secured favorable, confidential settlement on behalf of inspection company early in the discovery phase of lawsuit brought by pipeline owner seeking over $42 million in damages allegedly caused by defective welding performed during the installation of a new, 31-mile pipeline.
  • Successfully defended joint venture co-owned by publicly traded companies, in arbitration filed by an electric utility that sought over $300 million under the terms of the parties' 30-year power purchase agreement.
  • Provided general and legal advice to internal and external corporate affairs and governmental affairs teams of public-company client.
  • Managed quiet title actions in Colorado state court for oil and gas company.
  • Acted as local counsel for client accused of securities law violations in federal court.
  • Represented client on pro bono basis in federal court bench trial as first-chair trial counsel.
