Defeated a nine-figure class action for a major insurer in Washington.

WTO defeated certification and won summary judgment in a nine-figure, 80,000 member class action in Washington alleging that WTO’s insurance company client violated regulations governing how insurers must value total loss vehicles. The allegations involved further claims that our client breached the policy and violated consumer protection statutes. This victory is set to be an industry game-changer in a series of similar class actions filed across the country.

After litigating the case for two years, WTO sought summary judgment and decertification. Just one month before the scheduled trial, the judge agreed with our arguments, decertified the case, and entered summary judgment in our client’s favor. The plaintiffs had sought nine figures in damages plus fees, with their last settlement in the high eight figures.
