Jury finds for defendant LLC, defeating claims of distribution of funds violations
Wheeler Trigg O'Donnell represented a limited liability company against allegations that distributions of funds made in 2001 to members of the LLC violated the company's operating agreement. At trial, the plaintiffs presented a contract interpretation that was inconsistent with both the operating agreement's plain language and the members' prior practices. Following a one-week trial, the jury agreed with WTO's interpretation of the agreement, and entered a verdict in our client's favor.
