• Won dismissal with prejudice in a putative wage-and-hour class action in Kentucky. After defeating the plaintiff's attempt to obtain nationwide discovery against WTO's client, WTO then filed a summary judgment motion on the plaintiff's claims. Rather than opposing the motion, the plaintiff agreed to dismiss his claims with prejudice.
• Won a second unanimous jury verdict for a leading auto-parts manufacturer in an 11-year-old breach of contract dispute in federal court in Kentucky. Due to the results of a prior appeal, WTO's client held the burden of proof on key issues in the trial.
• Obtained Rule 12 dismissal for a Midwest-based, AmLaw 200 firm facing claims exceeding $500 million in state court in Kentucky.
• Won a complete defense jury verdict for a major auto parts manufacturer in federal court in Kentucky. WTO was called in just six months before trial in this protracted contract dispute that had already included two trips to the Sixth Circuit.
• Won a unanimous defense verdict in a $55 million trial in eastern Kentucky for a hospital accused of malpractice.
• Successfully represented a Fortune 20 company in class action and insurance litigation arising from a six-alarm warehouse fire. WTO's client paid just 1% of claims—which it then recovered through affirmative claims against other parties and their insurers.
• Won a defense verdict in Kentucky for Ford Motor Co. in a rollover case involving a Mazda pickup truck.
