This article, co-authored by WTO attorney Theresa Wardon and Northwestern University law professor James Pfander, offers the first considered examination of the immigration constitution of the early Republic, shows that the framers perceived the rules of naturalization as tantamount to rules of immigration law, and applies the norms of uniformity, prospectivity, and transparency to problems in modern immigration and naturalization law.
