Biography

Shiloh Rainwater has significant experience litigating cutting-edge appeals and commercial disputes spanning a wide range of subjects and industries. Prior to joining WTO, he was Senior Counsel at an AmLaw 50 law firm and was based in the New York City office.

His experience includes representing clients in some of the most important appeals in recent years before state and federal appellate courts across the country, including at the certiorari and merits stages in the U.S. Supreme Court. He also routinely handles dispositive briefing and spearheads strategy in high-stakes trials and arbitrations. His varied experience includes representing clients in disputes involving contracts, bankruptcy, constitutional law, labor and employment, real estate, and securities.

Shiloh maintains an active pro bono practice. Highlights include arguing and prevailing at the Second Circuit for an incarcerated client who brought constitutional claims against prison officials. He also achieved a rare victory for a veteran seeking benefits from the Department of Veterans Affairs related to the costs of pursuing an advanced degree.

Cases

  • Secured a victory at the U.S. Supreme Court for a federally appointed board overseeing an unprecedented municipal-debt restructuring in an appeal concerning the board's sovereign immunity.
  • Represented an AmLaw 50 firm and its clients in numerous appeals at the Second Circuit stemming from a sprawling global dispute over control of a major gas-shipping company.
  • Second-chaired a JAMS arbitration related to a $90 million dispute between members of an LLC that owns commercial real estate in Manhattan, New York.
  • Second-chaired an ICC arbitration involving a dispute between a prominent international media company and the former Middle East licensee of one of its iconic magazine brands.
  • Defended a nursing facility in a California mass-tort case centering on allegations of wrongful death related to COVID-19.
