WTO wins in Fifth Circuit in unfair monopolization case
FMC Corporation's Jetway division designed and manufactured airplane-passenger boarding bridges. When a competitor claimed that FMC was unfairly monopolizing the worldwide market for this product, Hugh Gottschalk developed evidence that a superior product, coupled with manufacturing and other business efficiencies, had allowed Jetway to acquire its large market share. The United States District Court for the Eastern District of Texas granted summary judgment to Jetway, and the Fifth Circuit affirmed.
