Won a defense verdict in a $27 million medical malpractice trial in Iowa.

Date: 05.08.23

A WTO team won a complete defense verdict for a neurosurgeon client and his employer accused of medical malpractice after a two-week trial in Polk County, Iowa. Nationally recognized plaintiff's lawyer Nick Rowley sought $27 million in damages at trial.

The plaintiff alleged that WTO's client negligently misplaced a screw during her spinal surgery, causing permanent nerve damage and leaving her left leg paralyzed. WTO’s team demonstrated that their client placed the screw within the medically determined “safe zone” and met the standard of care. The defense further showed that the screw was not touching any of the plaintiff’s nerves and therefore could not cause any harm. The jury agreed and returned a complete defense verdict for WTO’s client.
