WTO successfully defends the appeal of a 2009 jury verdict in a personal injury case
WTO successfully defended the appeal of a 2009 jury verdict in favor of its client, a large food store, in the New Mexico Court of Appeals. WTO was trial counsel and won the jury trial in Santa Fe District Court in September 2009. The trial involved a claim for permanent and disabling neurological injuries against WTO's client. Notwithstanding the defendant's admission that the plaintiff had received a permanent injury in the accident, the jury deliberated for only an hour before finding that WTO's client was not liable. While the Court of Appeals sustained the food store's position on appeal in all respects, it remanded the case for a retrial against the store's landlord.
