WTO's Fred Yarger Quoted in Law360's "Colorado Cases to Watch 2024"

He weighed in on a case that could change how insurers and policyholders navigate bad faith claims. The lawsuit from a hotel developer raises questions about the role of experts in claims investigations and the reach of attorney-client privilege. As part of his analysis, Fred questioned whether the Colorado Supreme Court will issue a broad ruling that updates decades-old case law or will instead send the case back to the trial court without meaningfully changing current law.
Fred also gave insight on a federal class action where Colorado justices will consider the reach of the state’s consumer protection law. The suit could be a test for how broadly Colorado's Consumer Protection Act applies, Fred told Law360.
