WTO's Fred Yarger Quoted on Colorado Damages Caps in The Denver Gazette
The Denver Gazette interviewed Wheeler Trigg O’Donnell (WTO) Partner Frederick Yarger for an article about Colorado’s cap on non-economic damages.
A $30 million jury award in a fracking explosion case reignites the debate over caps, the Gazette reported.
"One of the reasons that these caps are put in place is that non-economic damages are very hard to quantify," Fred told the publication.
He added, "It's not like economic damages where you can have some proof of lost earnings or medical bills or cost of care. It’s very much a general argument about non-economic loss, about pain and suffering that aren’t tied to concrete evidence."
