Biography

Alena Weicher represents major product manufacturers facing high-exposure product liability and personal injury claims. Her experience includes taking and defending depositions, drafting dispositive motions, developing discovery strategies in complex matters, and assisting with witness prep at trial. Before joining WTO, Alena was a judicial intern to the Hon. Elizabeth Brodsky, the Hon. Kristy Martinez, the Hon. Robert Lochary, and the Hon. Lisa Teesch-Maguire. She also worked as a legal assistant at Weicher Law Offices and as a high school English teacher.

In law school, Alena was the articles editor for the University of Colorado Law Review. She also served as a student attorney in the University of Colorado Advanced Civil Practice Clinic representing individuals affected by the Marshall Fire. Alena was an AAJ Mock Trial Team Member and on the Dean’s List.

  • Member of trial team that won a jury verdict for DISH Wireless in a cell tower contract dispute worth hundreds of millions of dollars.
  • Won dismissal on summary judgment for a scissor lift manufacturer in a warehouse fire dispute.
  • Represent an international tire manufacturer in product liability claims involving passenger and light truck tires.
  • Authored amicus brief filed in the Fifth Circuit in support of a petition for rehearing en banc in a case involving the civil rights of foster children.
  • Represent an individual hospital in cases involving medical negligence and premises liability, including OSHA violation claims.
  • Researched a new application of existing law post-COVID and drafted an Order to Take Testimony for Use in a Foreign Proceeding Pursuant to 28 U.S.C. ยง 1782 to compel a Colorado resident to testify in a Canadian trial.
  • Drafted internal memorandum regarding settlement agreement enforcement in a civil litigation matter and qualified immunity and PLRA limitations for a pro bono excessive force claim.
  • Represented clients at the Advanced Civil Practice Clinic defending eviction proceedings stemming from the Marshall Fire.
  • Researched and composed memorandum contrasting FRE 404(b) and CRE 404(b) rules for admissibility of prior acts.
  • Assisted in a pro bono immigration court matter for a Congolese individual seeking asylum.
  • Advised clients of the Federal Pro Se Clinic regarding First Amendment and employment discrimination concerns.
  • Representing Skyjack as national trial counsel in product liability cases involving aerial lift and boom equipment.
