Defeated class certification for Whirlpool in a refrigerator class action in Arkansas.

Rush v. Whirlpool, (W.D. Ark. 2008)
Date: 11.13.08
Wheeler Trigg O'Donnell attorneys defeated the plaintiffs' attempts to certify a multistate class action against Whirlpool Corporation based on allegations that certain Whirlpool-manufactured refrigerators were defective.  The victory came after an intense discovery and briefing period ordered by the court in which the plaintiffs repeatedly tried to obtain certification bamending their class definitions.  The U.S. District Court for the Western District of Arkansas agreed with WTO's arguments opposing class certification and refused to certify any class, no matter how defined.
