Biography

Jessica Eller represents clients in complex commercial litigation matters, contract disputes, franchise disputes, and class actions. Prior to joining WTO, she served as a judicial extern to The Honorable Timothy M. Tymkovich of the U.S. Court of Appeals for the Tenth Circuit and Chief Justice Brian D. Boatright of the Colorado Supreme Court. Jessica graduated second in her class from the University of Colorado Law School.

While in law school, Jessica successfully defended an excessive force claim from an appeal before the U.S. Court of Appeals for the Tenth Circuit. She also assisted a criminal defense attorney with securing a resentencing for a client who had erroneously received an enhanced sentence at trial.
 

Cases

  • Obtained decertification of an FLSA conditional collective that had been certified before WTO took over the case. After the decertification decision was issued, lawyers for the plaintiffs conceded that another pending nationwide case—which WTO also was defending—should be decertified as well.
  • Represented a national digital savings platform and won dismissal of a purported claim for civil theft.
  • Representing one of the nation's largest beauty and wellness franchisors in breach of contract, theft of trade secrets, and non-compete violation matters.
  • Representing a national real estate investment company in breach of contract disputes.
  • Representing a global nonprofit in a wrongful termination case.
