Won an arbitration award for a lawyer and law firm against malpractice claims related to a 2014 real estate deal.
WTO attorneys Carolyn Fairless and Shawn Neal
WTO attorneys won a complete defense award against malpractice claims brought by a real estate development company after a 2014 land purchase. The developers asserted that WTO’s client failed to properly review title information relevant to the transaction. However, the arbiter agreed with WTO that title review was not within the scope of what the lawyer and law firm were hired to do and no malpractice took place. The claimants had asserted $3 million in damages plus interest. In addition to finding against the claimants, the arbiter ruled for WTO’s client on a counterclaim for unpaid legal fees, plus interest.
