WTO attorneys obtained vacatur of a $3 million property damage appraisal award against client American Family related to a 2013 hail damage claim. The appraisal award amount was approximately five times greater than the amount estimated by American Family. In the opinion, the Chief Judge for the United States District Court for the District of Colorado disqualified the plaintiff’s national property appraiser on the grounds that he was not impartial and had direct financial interests in the amount of the appraisal award. The Court also disqualified the umpire for partiality, due in part to his prior work with the plaintiff’s appraiser.
