Won for AT&T before the Tenth Circuit Court of Appeals in an ERISA case.
WTO lawyers prevailed for AT&T before the Tenth Circuit Court of Appeals, preserving our client's trial court victory. In this ERISA case, the plaintiff had claimed that AT&T improperly denied short-term and long-term disability benefits, argued that AT&T was liable for a variety of statutory penalties, and requested that the district court apply a new Colorado statute purporting to lower the plaintiff's burden of proof.
The trial court originally rejected the plaintiff's claims on the merits and concluded that the Colorado statute did not apply. The Tenth Circuit affirmed that decision.
