LaMar Jost, Clarissa Collier, Chris Peterson, and Dr. Holly Morgan won an issue of first impression before the Utah Supreme Court related to damage caps for the University of Utah under the Governmental Immunity Act. The case is University of Utah v. Tullis.
Based on legal arguments crafted and briefed by the WTO team, the Utah Supreme Court held a previous opinion in 1989 holding damage caps unconstitutional did not control whether the amended damage caps were constitutional.
The decision effected a sea change in medical malpractice damages law against the University and other state actors that had existed for over three decades.
