Cases
- Served as co-counsel to a hospital system in one week jury trial in Pennsylvania. Prepared fact and expert witnesses for trial and briefed and argued numerous motions. The case settled favorably after the first week of trial.
- Won dismissal for Skyjack in Pennsylvania District Court in a product liability matter involving alleged injury on a scissor lift. The case was dismissed on the basis of lack of personal jurisdiction.
- Won a defense verdict in Philadelphia, during the week of Christmas, for a hospital and its physician assistant who diagnosed muscle strain when in fact the plaintiff had an infection that resulted in the amputation of her leg. The jury agreed with WTO's arguments that, given the circumstances, the original diagnosis was reasonable.
- Hired two weeks before trial to defend a client in Pennsylvania against medical malpractice and negligence claims. The case settled during voir dire for well under half the plaintiff's demand.
- Won exclusion of plaintiffs' general causation experts in multidistrict litigation involving more than 600 claimants alleging the antidepressant Zoloft caused birth defects.
- Represented Northstar Rx LLC in consolidated actions in California, Pennsylvania, and New Jersey related to multiple generic prescription medications.
- Brought in just three weeks before jury selection, WTO won a complete defense verdict for Dana Corporation in an asbestos wrongful-death trial in Philadelphia.
- Won a defense decision for a Philadelphia psychiatric hospital in a two-day medical malpractice arbitration involving the death of a patient killed in an auto accident hours after being discharged.
- Won summary judgment motions in many jurisdictions, including briefing and arguing in an MDL in the Eastern District of Pennsylvania on a complex issue concerning the government contractor defense as it applies to equipment manufacturers in asbestos litigation, potentially impacting hundreds or even thousands of similar cases currently pending before the panel.
